General Conditions of Sale
These general conditions of sale (the “General Conditions”) regulate the sale of products marketed on www.sagrasse.com. All purchase agreements of products concluded through the website www.sagrasse.com and in accordance with the procedure referred therein, between the seller and the Customer, will be regulated by these General Conditions. All prices quoted are inclusive of VAT.
Acceptance of the Conditions of Sale
- The contract stipulated between Sagrasse and the Customer is to be considered concluded with the acceptance, even if only partial, of the order by Sagrasse.com, who reserves the right, to its unobjectionable judgment, to accept the order. The acceptance is understood to be tacit, unless in any way otherwise communicated in any way to the Customer. When placing an order in the various ways specified, the Customer declares he/she has read all the indications provided during the purchasing procedure, and to fully accept the General Conditions and terms of payment below reproduced.
- If the Customer is a final consumer (that is, a physical person who purchases the goods for purposes not related to his professional activity), once the procedure of online purchasing is concluded, he/she will print or save an electronic copy and, anyway preserve, these General Conditions of sale, in compliance with the provisions of art. 3 and 4 of the Legislative Decree n. 185/1999 on distance selling.
- The Customer is not entitled to damages or compensation, as well as any contractual or tort liability for direct and indirect damages to person and or property caused by the missing, or even partial acceptance of an order.
Purchasing methods
- The Customer can only purchase the products available within the catalogue ofcom at the time of the order being placed and visible at the website address www.sagrasse.com, as they are described in the relevant information pages. Sagrasse, therefore, reserves the right to alter the technical information of the products to adapt them to those provided by producers, with no obligation to give any notice. It is understood that the image to equipment of the descriptive card of a product can not be perfectly representative of its characteristics but to differ for color, dimensions, products accessories in figure. All support information acquisition (Glossary, Purchasing Guide, etc...) shall be construed as a simple generic material, not due to real characteristics of a single product.
- Correct receipt of order is confirmed by Sagrasse by a reply by e-mail, sent to the email address supplied by the Buyer. This confirmation message will contain date and time of receipt of the order and an “Order Number”, to be used in any further communication with Sagrasse. The message will include all data entered by the customer who agrees to verify the correctness and communicate any corrections, as described in this document. Moreover, the Customer, if signed in, will also be able to check the status of the order, by logging into the website dedicated to him/her in the "order status" area.
- In case of non-acceptance of the order, Sagrasse will give timely notice to Customer.
- The Customer can request the cancellation of the order until the moment in which the order is not yet in preparation in the warehouse and certainly not after the shipment. If the Customer has registered an account, he/she can see the status of the order in the "Order Status" section of his/her personal area.
- All prices on the site shall be construed as public prices, and therefore inclusive of VAT. Sagrasse reserves the right to change the prices at any time, without notice. In the event that a wrong and/or early derisory price is published, for any reason (error in our systems, human error, etc…), the order will be cancelled, also in case of initial validation.
- In the website www.sagrasse.com the amount of product available is visible at the time the order is being placed. Since the simultaneous access of many users and the simultaneous possibility of orders online can alter the availability of the product, Sagrasse does not ensure the certainty of allocation of goods ordered.
Methods of Payment

Bank Transfer in advance
In case of payment by Bank Transfer in advance, the dispatch of the order happens only after the actual accreditation on Sagrasse’s Bank Account, which must happen within 5 working days after the acceptance of the order, after which the order will come thought automatically cancelled.
Bank Transfer cause must contain the number of order which can be found in the confirmation email.
The bank details to use to pay with the Bank Transfer method are written on the confirmation email.

Credit card
In case of purchasing with the Credit Card method, simultaneously to the conclusion of the online transaction, the reference bank charges the customer the amount of the purchase. The credit cards that are accepted are Visa, Mastercard or American Express.
In case of purchasing with an American Express credit card, the fulfillment of the order could be delayed due to anti-fraud measures of the banking system. Moreover, we remind you that the destination address of the goods must correspond to the one declared at the time of the issue of the card: otherwise you must contact the call center American Express to the number 06-72280371 to authorize shipment to a different address.
In the case of cancellation of the order, both by the Customer as well as in the event of failure to accept the same by Sagrasse shall simultaneously request cancellation of the transaction and release of the amount reserved.
The cancellation of the order is possible until the moment in which it is not yet in preparation at the warehouse. The status of the order is clearly visible in the “Client” section of the website, if signed in, and is not cancellable anymore if the icon “Sent” appears. The time required to redeem the payment with some types of credit cards depends solely on the bank, and may in some cases be made on the natural expiry (usually the 24th day from the date of authorization). Requested the cancellation of the transaction, under no circumstances Sagrasse can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.
Sagrasse, at its discretion, can request to the customer at any time documentation or further information proving the ownership of the credit card used for the transaction. If the documents requested are not provided, Sagrasse reserves the right not to accept the order.
At no point in time during the purchasing procedure is Sagrasse in a position to know the buyer's credit card number, since the latter is directly transmitted to the administrator of the banking service, that manages the transaction (with very high safety standards); It's not possible that data are intercepted, because no data are transmitted. No archive of Sagrasse contains, or maintains such data. In no event Sagrasse may therefore be liable for any fraudulent use of credit cards and unfair third party, in relation to payment for the products purchased on www.sagrasse.com

PayPal
In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the PayPal login page.
The amount of the order will be charged to your PayPal account at the time of acquisition thereof.
In case of cancellation of the order, both by the Customer as well as in the event of failure to accept the same by Sagrasse, the amount will be refunded to the Customer’s PayPal account.
The cancellation of the order is possible until the moment in which it is not yet in preparation at the warehouse. The status of the order is clearly visible in the “Client” section of the website, if signed in, and is not cancellable anymore if the icon “Sent” appears.
Requested the cancellation of the transaction, under no circumstances Sagrasse can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure Sagrasse is able to know the financial information of the customer. It's not possible that data are intercepted, because no data are transmitted. None of Sagrasse’s computer archives contains or stores such data. For every transaction made through PayPal the customer will receive an e-mail confirmation from PayPal.
Security of the transactions
The online transactions with credit cards are made directly on the Bank’s website, via a secure server that adopts the system of protection SSL (Secure Socket Layer). This protocol, allows communication in a way designed to prevent any case of interception, alteration or falsification. Sagrasse does not get to know the details of the Credit Cards used by its own Customers.
Delivery method
For every order placed on www.sagrasse.com, Sagrasse emits a sales note (the equivalent of a tax receipt) or an invoice of the material that has been sent. The information provided by the Customer with the order will be used for tax receipt issuance. After issuance of the document, no variations will be possible.
The shipping costs are charged to the Customer and are shown explicitly at the time of the order placement.
The payment of the goods by the customer will be made using on the choice of the order. No expenditure or commission is due to Sagrasse.
The delivery of the goods purchased is delivered truck board, if not otherwise specified.
The goods travel with a packaging directly realized by the producer, in cardboard boxes sealed with security tape or in shipping bags with self-adhesive hook depending on the warehouse of provenience. In no other cases the courier’s adhesive tape is used or other material of closing.
The goods will be shipped after 5 days after payment receipt, times of delivery are variable depending on the destination location and depending on the couriers, the same may change for reasons of force major or because of traffic and road conditions in general or by act of the Authority. Standard delivery will take place at the following times: from 9.00 AM to 1:00 PM; from 2:00 PMto 6:00 PM, every day, except holidays, from Monday to Friday.
No responsibility can be attributed to Sagrasse in case of delay in the order or delivery of goods ordered.
At the time of the delivery of the goods by the courier, the Customer is required to check:
- That the number of items delivered corresponds to what is written on the delivery note or transport document (DDT);
- That the packaging is not damaged or wet or otherwise altered;
- That no closing materials different from the already mentioned have been used;
Any damages or mismatch in the number of packaging or any other information, must be disputed immediately with the courier, adding the words "subject to withdrawal because the package is damaged", or “subject to withdrawal due to open package” or “subject to withdrawal due to missing packages” on the accompanying document.
Once signed the courier’s document, the Customer will not be able to oppose any dispute about the external characteristics of what has been delivered.
Possible hidden damages or defects will have to be notified to Sagrasse’s Customer service sending an email to the address info@sagrasse.com. The request must be made no later than 8 calendar days from the receipt of the goods.
Any notification after said terms, will not be taken into consideration. For each declaration the customer assumes full responsibility for what is said.
The cost of delivery
The cost of delivery is automatically calculated as a function of the weight of purchased products, includes the insurance of goods during the transport and is clearly stated at time of order. The costs mentioned are valid for all area of Italy and Europe.
The right of withdrawal
- In accordance of the Code of Consumption, as amended by the Legislative Decree n. 21/2014, the Customer having the qualification of consumer and, therefore, a physical person acting for purposes other than their professional activity, has the right to withdraw from the purchase contract, without providing any motivation and without incurring any costs other than those provided for in paragraph n.3, no later than 14 days after the delivery, that is from the day when the Customer or a third party designated by the latter acquires physical possession of the goods purchased. The conditions and procedure for exercising this right will be specified in the following paragraphs.

The Customer who intends to exercise the right of withdrawal indicated in the previous paragraph will have to send an email to the address info@sagrasse.com and indicate which product/products he/she intends to return and the quantities. In any case, the Customer has the faculty to communicate by ordinary mail, registered mail, email, or any other form of communication, his/her wish to avail himself/herself of the right of withdrawal, within the terms established by law. Sagrasse’s customer service will take charge of the request and manage the procedure.
- The shipment of the goods to be returned must take place no later than 14 days from the date on which the Customer has communicated to Sagrasse the decision to withdraw from the purchase contract. Sagrasse, in compliance with art. 56 of the Legislative Decree n. 21/2014, after verification of compliance with the conditions provided for in paragraph 4, will reimburse the client for the cost of the product within 14 days after the receipt of the notice of withdrawal, except for the right to get the refund until the date of the return of the product at its Warehouse or until the date on which the Customer will send proof of the actual dispatch and delivery of the goods to the courier. Sagrasse is not required to reimburse additional costs if the customer has chosen a type of delivery other than the least expensive delivery (“base” delivery). The refund will be made using the same methods used by the Client for the purchase, namely, if specifically requested, by bank transfer, credit card cancellation, PayPal refund or postal order (in this case, the costs will be charged to the Customer).
- The right of withdrawal is subject to the following mandatory conditions:
- The Customer can exercise the right of withdrawal only and exclusively with regard to the whole product;
- The purchased product will have to be returned in his original packaging, complete with all its documentation;
- The product will have to be returned in perfect condition, products that show signs of damage, wear or dirt will not be accepted;
- The right of withdrawal is forfeited if the Customer does not return the goods to Sagrasse within 14 days after the date in which he communicated the withdrawal itself. The end of the 14 days is considered respected if the Customer sends back the goods before the expiration of the same term. The right of withdrawal is also forfeited in case of major defects of the returned product (missing inner package, documents and/or original packaging of the producer; damage; unfit state of return) and in general, in case of non-compliance with the conditions indicated in paragraph n. 4. In all cases of forfeiture of the right of withdrawal, Sagrasse will return the goods to the customer who will not be entitled to any refund.
Waiver of purchase
Please be informed that the customer is entitled to reject the goods upon delivery. It does, however, note that the issue of the credit note for refund, in case of advance payment (credit card, PayPal, bank transfer), will be written off shipping costs up to the delivery and return to sender. Therefore, only the amount of the product will be reimbursed, net of return transportation costs.
Privacy
The personal data requested in phase of forwarding the order, are collected by Sagrasse and treated on computer media, in order to fulfill the requests rising from the contract concluded with the Customer. Sagrasse guarantees its Customers compliance with current legislation on the processing of personal data, as described by the EU Regulation 679/2016 (hereafter “GDPR”) and by the Privacy Code of Legislative Decree n. 196 of 30.06.03, as amended by Legislative Decree 101/2018. Claims
Any complaint should be directed to Sagrasse, Via Marche 18, 62010 Morrovalle (MC).
Conditions
The conditions contained in this document may be changed by Sagrasse without any notice and shall be valid from the date they are published on the Internet Site www.sagrasse.com.
